On Tuesday, 25th April, we had the pleasure of organising the breakfast seminar “Brexit: Dispute Resolution and Contracts” in collaboration with our patron SCA ONTIER, who hosted the event.
The target was to analyse how Brexit can impact in cross-border dispute resolutions. For that reason the first part of the seminar was focused on explaining the current scenarios within international agreement resolutions and the second part was based on trying to figure out what will be the post Brexit position.
Our Foreign Trade Manager Abel Plasencia, gave a warm welcome to the attendees on behalf of the Chamber and introduced the speakers: Mr. Juan Barthe, specialised in arbitration and litigation at Ontier Spain and Mr. William Russell, Senior Associate at SCA Ontier UK.
To give us a general overview about the subject Mr. Russell reminded to the attendees the latest Brexit developments like the Great Repeal Bill or the recently announced General Election. After giving us that small feedback, he developed the current regulation of the four main areas of dispute resolutions: Jurisdiction, Governing Law, Enforcement of Court Judgement and Taking of evidence.
Following on from this, Mr. Barthe started listing the possible post Brexit scenario depending on the kind of the agreement that the UK would reach with the EU. Once he developed those positions he gave the attendees some useful tips in order to guarantee the life of our contracts amending it into the best way.
Before the seminar was over, a Q&A round was made in order for participants to expose their doubts and questions to the two speakers.
To conclude the seminar, participants were invited to enjoy breakfast, while they were given the opportunity to discuss the session’s ideas.
