Thinking about relocating to Spain while working remotely? Spain’s Digital Nomad Visa continues to attract international professionals seeking to combine remote work with the lifestyle and opportunities the country offers.
To help applicants better understand the process and requirements, members of Scornik Gerstein LLP’s specialist immigration department have prepared an updated Spanish Digital Nomad Visa 2026 Guide. In it, they outline some of the key legal, professional and tax considerations for non-EU nationals looking to live and work remotely from Spain.
Below are some of the main points covered in the guide:

Does the Digital Nomad Visa include family members?

Yes, a successful applicant is entitled to bring his/her spouse and children under 18 and over 18, provided that they are still financially dependent on the applicant.

How long can a Digital Nomad Visa holder stay in Spain?

Digital nomad visa holders can stay in Spain for up to 5 years, depending on the type of permit granted.

Where must a digital nomad working from Spain pay its taxes?

Digital nomads living in Spain are likely to become Spanish tax residents, which means being taxed on their worldwide income unless they benefit from the special tax regime for inbound workers, commonly known as the Beckham Law.

What are the benefits of the Beckham Law regime?

Spanish Tax Residents pay taxes at a progressive tax rate from 19% to 47% on their  worldwide income. In contrast, Non-Spanish Tax Residents – and therefore those having gained Non-Spanish Tax Resident status under the Beckham Law – pay taxes at a flat rate of 24% up to the amount of 600,000 Euros and of 45% thereafter on their Spanish income, leaving any income gained outside Spain to be levied at the corresponding foreign jurisdiction.

Employment or work-related income is deemed to be obtained in Spain when working remotely from Spain, despite the employer or paying party being located outside  Spain.

To complement this, the guide includes a dedicated section on how to benefit from the Beckham Law regime.
